EVENT PHOTOGRAPHY AGREEMENT

This Event Photography Agreement ("Agreement") is entered into on _____________ by and between:

1. SERVICES PROVIDED

Photographer agrees to provide event photography services for the Client on the above date. Coverage includes the hours, locations, and deliverables outlined in the booking invoice or proposal, which is incorporated into this Agreement by reference.

2. RETAINER & PAYMENT

  • A non-refundable retainer of 25% quoted price is required to reserve the event date.

  • The remaining balance of 75% quoted price is due 15 days before the event date.

  • If final payment is not received by the deadline, Photographer reserves the right to cancel services and retain the retainer.

  • No images, previews, or final galleries will be delivered until full payment has been received.

3. CANCELLATION & RESCHEDULING

  • The retainer is non-refundable under all circumstances.

  • If Client cancels, all payments made are forfeited.

  • If the event is rescheduled, Photographer will attempt to accommodate the new date but does not guarantee availability. If unavailable, it will be treated as a cancellation.

4. CREATIVE CONTROL

Client acknowledges that photography is a creative service. Photographer maintains full artistic control over:

  • shooting style

  • editing style

  • image selection

  • final delivery

5. IMAGE EDITING & ALTERATIONS

Client may not edit, alter, filter, recolor, crop, manipulate, or apply presets or AI edits to delivered images.

Images must be displayed exactly as delivered. Unauthorized editing is a violation of copyright and this Agreement.

6. COPYRIGHT & USAGE RIGHTS

  • Photographer retains full copyright ownership of all images.

  • Client receives a personal or business-use license depending on booking purpose.

  • Images may not be sold, re-licensed, or distributed to third parties for profit without written permission.

7. PROMOTIONAL USE RELEASE

Client grants Photographer irrevocable permission to use photographs for:

  • portfolio

  • website

  • social media

  • advertising

  • marketing materials

  • studio display

  • publications

  • competitions

  • any other lawful promotional purpose Photographer deems appropriate and safe.

8. DELIVERY TIMELINE

  • Sneak peeks (if offered): within 7 days.

  • Full gallery: within 3 weeks.

Delivery timelines may vary during peak seasons, holidays, emergencies, or unforeseen circumstances.

9. LIMITATION OF LIABILITY

If Photographer is unable to perform services due to illness, emergency, accident, act of God, equipment failure, or circumstances beyond control:

  • Liability is limited to a refund of payments received.

  • Photographer is not responsible for missed shots caused by:

    • schedule delays

    • guest interference

    • venue restrictions

    • weather

    • lack of cooperation

    • lighting limitations

    • timeline changes

10. FORCE MAJEURE

Photographer is not liable for failure to perform if prevented by circumstances beyond control including but not limited to natural disasters, acts of government, pandemics, strikes, war, or emergencies.

11. SAFE WORKING ENVIRONMENT

Photographer may terminate coverage immediately without refund if placed in unsafe or hostile conditions, including but not limited to:

  • harassment

  • threats

  • unsafe crowd conditions

  • illegal activity

  • physical obstruction

12. COOPERATION

Client agrees to:

  • provide accurate timeline

  • ensure access to event spaces

  • inform Photographer of restrictions

  • designate a point of contact

Photographer is not responsible for missed images due to lack of cooperation.

13. EXCLUSIVITY

Photographer shall be the sole professional photographer hired for the event unless otherwise agreed in writing. Guests may take photos but must not interfere with Photographer’s duties.

14. TRAVEL & OVERTIME

  • Travel beyond 65 miles may incur a fee.

  • Coverage beyond contracted hours is billed at $250 per hour.

15. FILE STORAGE

Final edited images will be stored for 12 months after delivery. After that period, files may be permanently deleted without notice.

16. INDEMNIFICATION

Client agrees to indemnify and hold Photographer harmless from any claims, damages, or liability arising from the event, including injury, property damage, or guest conduct.

17. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between parties and supersedes all prior discussions. Any changes must be in writing and signed by both parties.

18. GOVERNING LAW

This Agreement shall be governed by the laws of the state of Georgia.
