GENERAL PHOTOGRAPHY AGREEMENT

This Photography Agreement ("Agreement") is entered into on _____________ by and between:

1. SERVICES PROVIDED

Photographer agrees to provide photography services for Client on the above date. Coverage, session length, location, and deliverables are outlined in the booking invoice or proposal, which is incorporated into this Agreement by reference.

2. RETAINER & PAYMENT TERMS

  • A 25% non-refundable retainer is required 14 days before the session date to secure the booking.

  • The remaining 75% balance is due on the day of the photoshoot.

  • Payments not received by their due dates may incur late fees of $25 per day.

  • Photographer reserves the right to cancel services if payment is not received as agreed.

  • No images, previews, or final galleries will be delivered until payment has been made in full.

3. CANCELLATION & RESCHEDULING

  • The retainer is non-refundable under all circumstances.

  • If Client cancels, all payments made are forfeited.

  • Rescheduling is permitted one time with at least 3 hours notice and is subject to Photographer availability. Additional reschedules may require a new retainer.

4. CREATIVE CONTROL

Client acknowledges that photography is a creative service and agrees that Photographer retains full artistic control over:

  • posing direction

  • styling suggestions

  • editing style

  • image selection

  • final delivery

5. IMAGE EDITING & ALTERATIONS

Client may not edit, alter, filter, recolor, crop, manipulate, or apply presets or AI edits to delivered images.

Images must be displayed exactly as delivered. Unauthorized editing is a violation of copyright and this Agreement.

6. COPYRIGHT & USAGE RIGHTS

  • Photographer retains full copyright ownership of all images.

  • Client receives a personal-use license to download, print, and share photographs.

  • Images may not be sold, submitted to contests, published, or used commercially without written permission from Photographer.

7. PROMOTIONAL USE RELEASE

Client grants Photographer irrevocable permission to use photographs for:

  • portfolio

  • website

  • social media

  • advertising

  • marketing materials

  • publications

  • competitions

  • studio display

  • any other lawful promotional purpose Photographer deems appropriate and safe.

8. DELIVERY TIMELINE

  • Sneak peeks (if offered): within 7 days.

  • Full gallery: within 3 weeks.

Delivery timelines may vary due to peak seasons, holidays, emergencies, or unforeseen circumstances.

9. LIMITATION OF LIABILITY

If Photographer is unable to perform services due to illness, emergency, accident, equipment failure, act of God, or any cause beyond control:

  • Liability is limited to a refund of payments received.

  • Photographer is not responsible for missed images caused by:

    • late arrival

    • lack of cooperation

    • weather

    • location restrictions

    • lighting limitations

    • interference from others

10. FORCE MAJEURE

Photographer is not liable for failure to perform due to circumstances beyond control including but not limited to natural disasters, government actions, pandemics, strikes, or emergencies.

11. SAFE WORKING CONDITIONS

Photographer may terminate coverage immediately without refund if subjected to:

  • unsafe conditions

  • threats

  • harassment

  • illegal activity

  • obstruction

12. COOPERATION

Client agrees to:

  • arrive on time

  • follow agreed schedule

  • provide accurate information

  • ensure access to locations

  • communicate expectations clearly

Photographer is not responsible for missed images due to lack of cooperation or lateness.

13. EXCLUSIVITY

Photographer shall be the sole professional photographer for the session unless otherwise agreed in writing.

14. TRAVEL & OVERTIME

  • Travel beyond 65 miles may incur a fee.

  • Additional time requested beyond the agreed session length will be billed at $250 per hour.

15. FILE STORAGE

Final edited images will be stored for 12 months after delivery. After that time, files may be permanently deleted without notice.

16. INDEMNIFICATION

Client agrees to indemnify and hold Photographer harmless from any claims, damages, or liability arising from the session, including injury, property damage, or actions of participants.

17. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between parties and supersedes all prior communications. Any modifications must be in writing and signed by both parties.

18. GOVERNING LAW

This Agreement shall be governed by the laws of the state of Georgia.
