WEDDING PHOTOGRAPHY AGREEMENT

This Wedding Photography Agreement ("Agreement") is entered into on _____________ by and between:

Photographer: _______________________________, a legally registered LLC ("Photographer")
Clients: __________________________________________ ("Clients")
Event Date: __________________
Event Location(s): __________________________________________

1. SERVICES PROVIDED

Photographer agrees to provide wedding photography services for the Clients on the above date. Coverage includes the time, locations, and deliverables outlined in the booking invoice or proposal, which is incorporated into this Agreement by reference.

2. RETAINER & PAYMENT

  • A non-refundable retainer of 25% price quoted is required to reserve the event date.

  • The remaining balance of 75% price quoted is due no later than 30 days before the event.

  • No images, previews, or final galleries will be delivered until full payment has been received.

  • Late payments may result in delayed delivery or cancellation of services.

3. CANCELLATION & RESCHEDULING

  • The retainer is non-refundable under all circumstances.

  • If Clients cancel, all payments made are forfeited.

  • If the event is rescheduled, Photographer will attempt to accommodate the new date but does not guarantee availability. If unavailable, it will be considered a cancellation.

4. CREATIVE CONTROL

Clients acknowledge that:

  • Photography is a creative service.

  • Final images are delivered at Photographer’s professional discretion.

  • Photographer maintains full artistic control over shooting style, editing style, image selection, and final delivery.

5. IMAGE EDITING & ALTERATIONS

Clients may not edit, alter, filter, recolor, crop, or manipulate delivered photographs in any way.
This includes social media filters, presets, AI edits, or third-party editing.

Images must be displayed exactly as delivered. Unauthorized editing is a violation of copyright and this Agreement.

6. COPYRIGHT & USAGE RIGHTS

  • Photographer retains full copyright ownership of all images.

  • Clients receive a personal-use license to download, print, and share images.

  • Clients may not sell, publish, submit, or profit from images without written permission.

7. MODEL RELEASE & PROMOTIONAL USE

Clients grant Photographer irrevocable permission to use photographs for:

  • Portfolio

  • Website

  • Social media

  • Advertising

  • Marketing materials

  • Competitions

  • Publications

  • Studio display

  • Any other lawful promotional purpose Photographer deems appropriate and safe.

8. DELIVERY TIMELINE

  • Sneak peeks (if offered): within 7 days.

  • Full gallery: within 3 weeks.
    Delivery timelines may vary during peak seasons, holidays, emergencies, or unforeseen circumstances.

9. LIMITATION OF LIABILITY

If Photographer cannot perform services due to illness, emergency, accident, act of God, equipment failure, or other cause beyond control:

  • Liability is limited to a refund of payments received.

  • Photographer is not responsible for missed shots due to:

    • late schedule

    • guest interference

    • venue restrictions

    • weather

    • lack of cooperation

    • timeline changes

10. FORCE MAJEURE

Photographer is not liable for failure to perform if prevented by circumstances beyond control including but not limited to natural disasters, acts of government, pandemics, strikes, war, or other emergencies.

11. SAFE WORKING ENVIRONMENT

Photographer may end coverage immediately without refund if:

  • threatened

  • harassed

  • placed in unsafe conditions

  • subjected to illegal activity

  • obstructed from performing duties

12. COOPERATION

Clients agree to:

  • designate a point person for family portraits

  • provide accurate timeline

  • ensure access to locations

  • inform Photographer of restrictions

Photographer is not responsible for missed images due to lack of cooperation.

13. MEALS & BREAKS

For coverage exceeding 5 hours, Clients agree to provide Photographer with a meal and reasonable breaks.

14. FILE STORAGE

Photographer will store final edited images for 12 months after delivery. After that time, files may be permanently deleted without notice.

15. EXCLUSIVITY

Photographer shall be the sole professional photographer hired for the event. Guests may take photos but must not interfere with Photographer’s work.

16. TRAVEL & OVERTIME

  • Travel beyond 65 miles may incur a fee.

  • Coverage beyond contracted hours will be billed at $250 per hour.

17. INDEMNIFICATION

Clients agree to indemnify and hold Photographer harmless from any claims, damages, or liability arising from the event, including injury, property damage, or guest conduct.

18. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between parties and supersedes all prior communications. Any amendments must be in writing and signed by both parties.

19. GOVERNING LAW

This Agreement shall be governed by the laws of the state of Georgia.
